Terms of Service

These terms govern your use of CallThem, the business communication platform at callthem24.com (the “Service”). By creating an account or using the Service you agree to them, on your own behalf and on behalf of the company you represent. If you do not agree, do not use the Service. Our Privacy Policy explains how data is handled and forms part of these terms.
1. The Service
CallThem lets companies send and manage WhatsApp, Telegram and email messages, manage contacts and campaigns, schedule messages and follow-ups, and use an AI assistant that answers using the company’s own knowledge base. Features may change over time; we describe only what is live in the app.
2. Accounts
- You must give accurate information, be legally able to enter a contract, and keep your sign-in details secret. You are responsible for activity under your account, including by staff you invite.
- Company administrators decide who in their company has access and what role they have.
- Tell us promptly if you believe your account has been accessed without permission.
3. Third-party services
The Service depends on services run by others, including Meta’s WhatsApp Business Platform, Gupshup, Telegram (its Bot API, for companies that connect their own Telegram bot), Google (Firebase, Gmail) and AI providers. Your use of those services is also subject to their terms and policies, including the WhatsApp Business Policy, the WhatsApp Commerce Policy and the Google API Services User Data Policy. Those providers may restrict, throttle or suspend a phone number or account independently of us (for example for low quality ratings or messaging limits), and we are not responsible for their decisions.
4. Acceptable use
You agree to use the Service lawfully and in line with the third-party policies above. In particular, you will not:
- message people who have not given you the permission (opt-in) that WhatsApp and applicable law require, or ignore opt-out requests;
- send spam, deceptive, harassing, hateful, sexually explicit or illegal content, or content that infringes others’ rights;
- use the Service for prohibited categories under WhatsApp’s policies, or to run scams, phishing or other fraud;
- connect an email or WhatsApp account you do not own or have authority to use;
- attempt to break, overload, scrape or reverse-engineer the Service, bypass rate limits or billing, or access another company’s data;
- upload malware, or use one-time-code or notification messages to repeatedly contact a person who has not asked for them.
We may suspend or restrict an account, message or API key that we reasonably believe breaks these rules or endangers the Service or others.
5. Your content and data
You keep ownership of the contacts, messages, knowledge base and other content you put into CallThem. You give us the right to host, process and transmit it, and to send it to the third-party services described above, solely to provide the Service to you. You are responsible for having the rights and consents needed to upload it and to message the people in it.
6. AI features
The AI assistant generates replies automatically, including replies to customers on WhatsApp and Telegram and, if you enable it, to incoming email. AI output can be wrong, incomplete or unsuitable. You are responsible for configuring your knowledge base and instructions, for reviewing how the assistant behaves, and for what is sent in your name. Do not rely on it for legal, medical, financial or other advice, and do not use it for decisions that significantly affect people without human review.
7. Plans, wallet and payment
Some features require a paid plan, prepaid balance or invoice-mode billing, as shown in the app and on the pricing page. Usage such as messages, photos and voice is metered and deducted or invoiced as described there. Fees are charged in advance or invoiced as shown, and are non-refundable except where the law requires or we state otherwise. Messaging fees charged by WhatsApp or other providers may be passed through. We may change prices with reasonable notice; changes do not affect amounts already paid for a period.
8. Platform API
API keys grant access to your company’s sending capability. Keep them secret, give each key only the scopes it needs, and revoke any key you think is exposed. You are responsible for everything sent with your keys. Use the API only for the message types you have consent for; CallThem does not generate or verify one-time codes on your behalf.
9. Availability and changes
We work to keep the Service running but do not guarantee it will be uninterrupted or error-free. It may be unavailable for maintenance, or because of failures at Meta, Gupshup, Google or other providers. We may add, change or remove features; if we remove a paid feature we will treat any prepaid, unused portion fairly.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms, if required by law or by a third-party provider, or if your account is unpaid. On termination your right to use the Service ends; sections that by nature should survive (ownership, disclaimers, liability, payment owed) survive.
11. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that messages will be delivered or read.
12. Limitation of liability
To the fullest extent the law allows, CallThem will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnity
You will defend and compensate us against claims and costs arising from your content, your messaging (including missing consent), or your breach of these terms or of third-party policies.
14. Changes to these terms
We may update these terms. If a change is material we will update the date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after a change takes effect means you accept it.
